What do you need to do when you cease being a registered agent of a company

A registered agent is a person that acts as an intermediate between ASIC and a company to help the company to fulfil its obligations more easily. Registered agents are usually members of certain Industry associations that have recognised qualifications and experience. A registered agent can be for example a tax agent. Registered agents will need to register for online access and create an account to be able to use ASIC's online services to be able to look after the affairs of their clients' companies online. A registered agent can manage several clients' through their online accounts.

If you stop being represented by a registered agent you will first need to submit a Notification to nominate or cease a registered agent online. You would also need to check the address for your company as your company can sometimes have the address of your previous registered agent listed as their registered office.

If after ceasing a registered agent you have decided to appoint a new registered agent you would have to lodge the form Notification to nominate or cease a registered agent which is to be lodged online.

For registered agents

 If you are the registered agent for a company and have stopped being so you must check the registered office address for the company. If the company has your address listed as the registered office address and you are no longer their registered agent you would need to update their registered office address by completing the Change to Company details online before you stop being the registered agent for the company. You also would need to lodge online a Notification of a registered agent ceasing to act for a company

Sometimes you may fail to update the address of the registered office of a company in time and may receive mail for a company for who you have ceased to be a registered agent. In this situation you must not return the mail to ASIC as this will not stop the mail being sent by ASIC. You will need to send an online enquiry stating that you withdraw consent for the company (here the full name of the company needs to be included) to use your address as its registered office. You must also include the address where the mail is being sent incorrectly
